Work Injury Lawyer: The Injuries We Handle

A work injury lawyer makes sure workers’ comp pays for the treatment and time off your injury actually needs, not what the insurer would prefer to pay. Here are the injuries we help San Diego County workers with most often:

How workers’ comp handles a work injury

Workers’ comp treats two kinds of injuries a little differently. A specific injury happens at one moment, like a fall or a lifting accident. A cumulative trauma injury builds up over months or years of the same motions. Both are covered, but insurers dispute cumulative injuries more often.

Your treatment usually goes through your employer’s medical provider network, and your treating doctor decides when you can work and what restrictions you need. When your doctor and the insurer disagree, the case often goes to a Qualified Medical Evaluator (QME).

If the insurer refuses your claim at any step, see our page on denied workers’ comp claims.

Work injury questions

What should I do right after a work injury?

Get medical care, report the injury to your supervisor in writing, and ask for a claim form (DWC-1). Write down how it happened and who saw it, and keep copies of everything you sign or receive.

What if my work injury was partly my fault?

It usually doesn’t matter. Workers’ comp is a no-fault system, so a mistake on your part generally doesn’t bar benefits. There are narrow exceptions, such as injuries caused by intoxication.

I didn’t see a doctor right away. Can I still file?

Yes. Report the injury as soon as you can and get checked. A gap between the injury and your first treatment gives the insurer an argument, so explain the delay to the doctor and write down what happened while you remember it.
